Terms of service

These terms are the agreement between you and WhimApply (“we”, “us”) when you use whimapply.com. They are deliberately short and in plain English: what the service is, what we each promise, and where responsibility sits. By creating an account or using the site you agree to them.
How we handle your data lives in the privacy policy, which is part of this agreement.
1. The service
WhimApply is a UK job search platform: it matches live job postings to your profile, explains the match, tracks your applications, and helps tailor your CV and letters. It is an early product under active development: features will evolve, and some shown as coming (like paid plan checkout) are not yet live. We will not remove anything you rely on without notice.
2. Your account
- You must be at least 16 and able to work in, or be seeking work in, the UK job market.
- Keep your sign-in credentials to yourself; you are responsible for activity on your account.
- Give us accurate information. The product matches jobs to what you tell it; fiction helps no one.
- One account per person, and it is yours: accounts cannot be sold or transferred.
You can close your account at any time by emailing support@whimapply.com; the privacy policy explains what happens to your data when you do.
3. Your content
Your CV, profile and everything you upload remain yours. You give us permission to store and process them only as needed to provide the service: extracting your profile, scoring matches, generating drafts, autofilling applications you choose to make. We never show your CV to anyone without your say-so, and we do not sell access to it. You promise that what you upload is yours to upload and is not unlawful.
4. Acceptable use
Do not:
- scrape, harvest or bulk-download the service or its job data;
- access the service by automated means outside the interfaces we provide;
- probe, bypass or overload our security and rate limits;
- use the service to spam employers or to impersonate anyone;
- upload malware or content that is unlawful, or attempt to disrupt the service;
- resell or white-label the service without our written agreement.
We may suspend or close accounts that break these rules, acting proportionately and telling you why unless the law or security prevents it.
5. Job listings and applications
Job postings come from third-party sources and from employers’ own pages. We work to keep them accurate and current, but:
- we do not control listings and cannot guarantee a posting is accurate, still open, or lawful;
- applications are between you and the employer: we are not an employment agency, recruiter or party to any hiring decision;
- match scores and generated drafts are assistance, not advice or a promise of outcome. Read what you send before you send it.
6. Paid plans
The core service is free to use today. Prices shown on the pricing page describe the intended plans; nothing is charged until checkout actually exists, and when it does, billing terms (renewal, cancellation, refunds) will be added here and shown clearly before you pay. No silent changes.
7. Availability and changes
The service is provided “as is” and “as available”. We aim for it to be fast and dependable, but we do not promise uninterrupted or error-free operation, and we may change, suspend or withdraw features as the product develops. We will give reasonable notice of changes that materially reduce what you get.
8. Liability
Nothing in these terms excludes liability that cannot be excluded under the law of England and Wales, including for death or personal injury caused by negligence, or for fraud.
Beyond that: we are not liable for hiring outcomes, for the content or conduct of employers and job boards, or for indirect losses (lost profits, lost opportunities). For a free service our total liability is capped at £100; if you are on a paid plan when one exists, it is capped at what you paid us in the twelve months before the claim.
9. Ending the agreement
You can stop using WhimApply and close your account whenever you like. We can suspend or end accounts for breach of these terms as described in section 4, or shut the service down entirely with reasonable notice, in which case you will have the chance to export your data first.
10. Changes to these terms
When these terms change materially we will update the date at the top and notify you by email or in the product before the change applies. Continuing to use the service after that means you accept the updated terms.
11. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, though if you live in Scotland or Northern Ireland you keep the protections and courts your local law gives you.
